The City of Carmel established the Board of Zoning Appeals as part of the zoning ordinance, which applies to all of Clay Tonwship within Hamilton County. The Board of Zoning Appeals has territorial jurisdiction over all the land subject to the zoning ordinance.
BZA normally meets at 6PM every 4th Monday od each month at armel City Hall.
An alternate procedure to being heard by the full BZA is to be heard by a BZA Hearing Officer. The BZA Hearing Officer is a member of the BZA (Board of Zoning Appeals) who is enabled the final voting authority on a variance or special use petition. Petitions that are heard by the Hearing Officer are usually variance requests that would not be controversial at all.
The timeline to be heard by a BZA Hearing Officer is usually about 10 days shorter than the regular 45-day BZA process. This is because the public notice requirement is 10 days prior to the public hearing meeting, rather than 25 days prior to a regular BZA meeting. Also, the application filing fees are less for a BZA Hearing Officer item. Additional information about the Hearing Officer is located in Section 30.08 of the Carmel Zoning Ordinance.
